This agreement constitutes a contractual agreement between the Guest and TLE/Cambria Sunset. Please read this Vacation Rental Agreement thoroughly prior to signing. Please return to our office via email, fax or mail. Any monies received by TLE/Cambria Sunset for occupancy of this vacation rental property indicate the acceptance of the terms and conditions of the Vacation Rental Agreement. It is the responsibility of the Guest(s) to be familiar with all policies within this agreement. This rental agreement is entered into by and between the renter hereinafter referred to as Guest(s), and TLE/Cambria Sunset, hereinafter referred to as Owner.

Reservation – Reservations are not considered guaranteed until this signed rental lease agreement and payment of at least 20% of the total rental amount including cleaning fee and taxes, are received by Owner. Reservations booked less than 30 days prior to arrival date will require payment in full. The balance of the rental amount is due 30 days prior to arrival to secure the rental property. Accepted Forms of Payment – MasterCard, Visa, Amex and Discover. When booked through VRBO, payments are made through and paid directly to VRBO, please check their payment acceptance options.

Damage – By signing this agreement, you are agreeing to be responsible for any damage, breakage or missing items and agree to follow proper departure checkout procedures for this rental property. Damage deposit options: 

When booking through VRBO, purchase damage insurance through VBRO ($59.99) or pay a refundable damage deposit of $1500.00. If booking through our website, credit card information will be kept on file in lieu of paying a damage deposit or pay a $1000.00 refundable damage deposit. You will be notified in the event of any damage, breakage or missing items prior to charging any amount for repair or replacement. (All paid upfront refundable damage deposits will be processed for a refund after condo has been checked by property manager and no damage has occurred).

Repairs/Service Calls - Owner cannot guarantee against mechanical failure of any appliances heating, AC, fans, TV,  printer, etc. Owner cannot guarantee against interruption of utility services including the internet, beyond their control. Please report any inoperative equipment or services immediately to the property manager. The property manager will make every reasonable effort to repair quickly and efficiently. Guest understands and agrees that Owner, Property Manager or its repair technicians might need access to the unit for the purpose of making the repair. (Note: All of the items mentioned were installed 2017, except heat and A/C.)

Refund Policy
- No refunds or rent reductions will be made due to failure of appliances, equipment, or services.
No refunds or rate adjustments will be given for inconvenience due to construction noise, road repairs, early
departures, delayed arrival, reducing the number of nights originally reserved or Acts of God including situations listed below. Owner and property manager will not be liable for events beyond their control which may interfere with Guest’s Occupancy, including but not limited to Acts of God, Acts of governmental agencies, fire, strikes, terrorism, war, or inclement weather. Owner will make all efforts to reschedule you reservations within one year of original arrival date. VRBO and their affiliates booking fees are not collected or refunded by TLE/Cambria Sunset. Please read the VRBO contract and regulations regarding their fees.

Cancellation – Reservations that are cancelled 30 days prior to arrival date will receive a full refund of monies paid. Reservations cancelled between 15 and 29 days prior to check-in will receive 50% of monies paid. Cancellations 14 days or less prior to arrival will forfeit all monies paid.

Age Requirements – You must be 25 years of age or older to make a reservation, pay for the reservation and you must be present at the condo during your reserved timeframe. Any reservations made under false pretenses will result in loss of any payments and possible removable of guest(s) from condo. A photo ID may be requested.

House Parties are not allowed – The person signing this agreement will be responsible for all guests and guest on this agreement. Guests agree to not disturb or offend neighbors (residents or guests/renters) and agree to respect the Colony Surf Condo Association by-laws of quiet time before 8:00 am and after 10:00 pm. Guests shall not discharge any firearms or       use fireworks or any kind on the premises. Guest agrees there will be no illegal activity of any kind in or on the premises. Guests staying in the condo may have visitors, and agree to limit the total number of guests and visitors combined not to exceed ten (10) people at a time. No visitors shall spend the night without prior approval. Guests are considered as those listed on this agreement.  Visitors are friends/family who come to visit. 

Smoking - No Smoking - This is a non-smoking facility per Colony Surf Condo Association by-laws. No smoking in the condo or covered parking area. Smoking in the common area is permitted. Guest will be assessed $500.00 for deep cleaning if smoking inside the condo.


Check-In Time – Check-in is 4:00 pm. The gate code and door code will be provided prior to your arrival. Our Property Manager uses reasonable efforts to have the rental property ready for Guest occupancy at the designated 4:00 pm check-in. The exact time of occupancy cannot be guaranteed. If the property is ready earlier than 4:00 pm, the Property Manager will attempt to notify you for early check in.

Check-Out Time – Check-out time is 10:00 am or before. Please be prompt as to allow housekeeping to have adequate time to prepare the condo for the next guests. A delay in departure will result in a $250.00 fee.

Occupancy –The maximum sleep occupancy of this condo is 8 total, including children. Guest agrees that no more than the number of persons listed on the reservation agreement shall occupy the premises overnight. An additional $75.00 per person, per night will be charged.

Furnishings – Furnishings are subject to change without notice. furniture, bedding, mattress pads, utensils and any other supplies must remain with the rental property. Loss of these items, as well as damage to the property or furnishings in excess of normal wear will be deducted from the damage deposit. If you require special assistance or equipment, please call and check if we can accommodate, or feel free to bring them with you.

Items Provided - Linens, wash cloths, bath towels, beach towels, beach chairs, trash bags, dish soaps and laundry supplies. A washer and dryer are provided in the condo for your convenience. Kitchen utensils, pans, dishes, glasses, as well as, a startup supply of toilet paper, paper towels, bath and hand soaps are supplied. Daily housekeeping service is not included during your stay. Mid-stay housekeeping may be requested for an additional charge. Food and toiletries are not supplied.

Pets - No Pets are allowed, no exceptions. We love pets, however, the guests after your stay may have allergies to pets. Bringing your pet constitutes violation of this agreement and immediate termination of your rental. You will be required to vacate the premises immediately and forfeit all rents and security deposits. Additionally, a $500.00 deep clean fee and charges for any damages will be required. (See Violation of Agreement below).

Parking – One (1) parking spot is available in the exterior parking area, please use the parking spot marked 401. Additional vehicles may park on the street. Condo Association By-Laws do not allow motorcycles, trailers, RV’s,
ATV’s, golf carts or boats in the parking area and have designated the underbuilding parking for residents use only. There is no electric vehicle charging of any kind available on the property.

Grilling – Grilling is available in the Common Area ONLY. No grilling is allowed on the balcony, as this is a potential fire hazard. A charcoal grill and picnic table are supplied for guests use.

Fireplace – The fireplace is electric and is provided for ambiance and minimal heat for cool evenings. Please do not throw paper or combustible materials in the fireplace.

Items Left Behind – Owner or Property Manager are not responsible for any items left behind. However, if they are found we will be happy to ship them to you. Arrangements can be made via phone or email.

Listings and Pricings – Information regarding individual listings is believed to be accurate, however, cannot be guaranteed. We have made every effort to ensure that all information on our VRBO listing and our Website(s) is current and accurate. The possibility of errors and omissions exist. Rates, furnishings, fees, and taxes are subject to change without notice. Guests who have paid a deposit are excluded from the possibility of rate changes and fees. Taxes are calculated accordingly, as required by the State of Florida and County of Pinellas. Combined 13% Violation of Agreement – If Guest violates any of the conditions of this agreement, Owner or Property Manager may terminate this agreement and enter the premises. Upon notice of termination of this agreement, Guest shall vacate the premises immediately and forfeit all rents and security deposits.

Confirmation – A confirmation Number will be provided to Guest once deposit payment has been made. Please read this agreement for accuracy of dates, property name, number of guests and charges. Report any errors to owner immediately upon receipt of agreement. Pay close attention to the number of persons on the agreement as occupancy is limited to registered guests only. Additional non-registered guests will incur additional charges. (See Occupancy Section above).

Check-out Procedures –The following are the responsibility of the guest at departure:   • Place any dirty dishes in dishwasher and start. • Please wash and dry beach towels the night before departure. • Please place all soiled or wet bath towels, hand towels and wash cloths in bath tub. • Take all trash bags to the dumpster located at the entrance of the exterior parking area. • Close and lock all doors and windows. • Please leave Condo in similar condition as check in.

IN CONSIDERATION for being permitted to enter premises and property for vacation rental, the guest(s), for himself/herself, his/her personal representatives, guests, children, heirs, and next of kin, acknowledges, agrees, and represents that he/she has or will immediately upon entering, and will continuously thereafter, thoroughly inspect such areas and his/her continued presence constitutes an acknowledgment that he/she has inspected house, yard and entire property and he/she finds and accepts such areas as being safe and reasonably suited for the purposes of his/her use, and he/she further agrees and warrants that if, at any time, he/she feels anything to be unsafe, he/she and all guests will immediately leave the area and advise appropriate persons. THE GUEST(S) hereby RELEASES, WAIVES, DISCHARGES AND COVENANTS NOT TO SUE TLE/Cambria Sunset and/or owners, members and/or Top Line Enterprises, LLC and/or the acting Property Manager and/or lessees of the premises, and/or Colony Surf Condos, and/or Colony Surf Condo Association, all for the purposes herein referred to as “releasees” from all liability to the guest(s), representatives, assigns, heirs and next of kin for any and all loss or damage, and any claim or demand thereof on account of property damage, Illness, Pandemic or INJURY to theperson(s), or resulting in DEATH of the guest(s), whether caused by negligence of the releasees or otherwise while in or upon the area. THE GUEST(S) hereby AGREES TO INDEMNIFY AND SAVE AND HOLD HARMLESS the releasees and each of them from any loss, liability, damage, or cost they may occur due to their presence in or upon the area and whether caused by the negligence of the releasees, natural risky conditions or otherwise. THE GUEST(S)
hereby ASSUMES FULL RESPONSIBILITY FOR RISK OF BODILY INJURY, DEATH OR PROPERTY DAMAGE, including, but not limited to the bunkbeds due to the negligence of the releasees, or otherwise while in or upon area. THE GUEST(S) hereby certifies that he/she and guests (they) have adequate insurance to cover any injury or damage that may be caused or suffered while in or upon area, or else agrees to bear the costs of such damage or injury. The guest(s) further expressly agrees that the foregoing release, waiver and indemnity agreement is intended to be as broad and inclusive as is permitted by law and that if any provision is held invalid, it is agreed that the balance shall, notwithstanding, continue in full
RELEASE AND WAIVER OF LIABILTY AND INDEMNITY AGREEMENT, and further agrees that no oral representations, statements, or inducements apart from the foregoing written agreement have been made.

By accepting the terms and conditions I agree that I am at least 25 years of age and that I will be responsible for the care of this rental property. I understand that Owners, Property Manager, Colony Surf Condos or Colony Surf Condo Association assume no responsibility for personal loss injury, or illness of any kind which may result from use of premises. Further I agree to all the terms and conditions of this agreement.
